Who decides that the seal should be partially lifted or lifted?
Only the court can lift the seal by issuing a court order. An order is secured when a motion is filed by the Government, the Relator or both parties.
How can the Government investigate & talk to witnesses about the lawsuit if the case is under seal?
Sometimes the Government and the Relator will ask the court for a “partial lifting” of the seal so that the complaint can be shown to a Defendant or a witness.
